The Business Litigation Department handles a broad range of business and commercial matters, including contract disputes, construction litigation, bankruptcy, health care, unfair competition, business torts, employment litigation, insurance disputes, environmental litigation, real estate litigation, corporate and partnership disputes and securities litigation. We typically defend CA businesses; however, we also initiate suits on behalf of our clients.

In the area of creditors’ rights and bankruptcy the Business Litigation Department handles all phases of creditors’ rights representation, including workouts, pretrial litigation, trials, appeals, pre and post judgment remedies and bankruptcy. We also have experience in all forms of alternative dispute resolution, encompassing arbitration and mediation.

Our Business Litigation Department represents clients throughout the state of South Carolina foreclosing mortgages, judgment liens, construction liens or other security interests against both real and personal property.

Our representation ranges from simple residential mortgage foreclosures to complex commercial foreclosures. Our attorneys and staff are well versed in the applicable laws affecting priorities and perfection of security interests. Our attorneys provide our creditor clients with a problem solving approach that enables our clients to enforce their rights quickly and economically.

The firm represents lenders and borrowers in restructurings of corporate and real estate transactions that are designed to avoid bankruptcy. Our ability to negotiate restructurings that are fair and realistic for our clients is enhanced by our strong corporate and real estate practice.

The firm practices in a number of insurance-related areas, such as advising insurers as to coverage under commercial liability, marine, inland marine, automobile, property and casualty, and other insurance policies. We also represent insurers in declaratory actions and actions to intervene in pending litigation, bringing policy rescission actions, and defending bad faith claims.

The firm has an active practice in a broad range of insurance coverage matters. We have long been at the forefront of insurance coverage litigation and appellate practice in CA. Our insurance coverage lawyers are members of the Defense Research Institute Insurance Coverage Committee and the American Bar Association Torts and Insurance Practices Section.

They regularly attend DRI Insurance Coverage symposia and are frequent contributors to the DRI publication Covered Events. Additionally, the group publishes its own quarterly newsletter for insurance clients, and our members lecture at continuing legal education seminars on insurance topics.

Our practice includes insurance coverage opinions for first party property and homeowners insurance, automobile insurance, marine insurance, life and accident insurance, comprehensive general liability insurance, commercial and business interruption insurance, professional liability insurance, and employment insurance.

All of our group’s lawyers are active litigators in the state and federal courts, and they have experience in prosecuting declaratory judgment actions.

The broad field of construction law has long been an area with which the firm has wide experience. We represent owners, contractors, sureties, subcontractors, suppliers, architects, and engineers in a wide variety of matters related to the construction field. Lawyers in our Construction Practice Group can assist in negotiating contracts and can handle all aspects of claims, arbitration, and litigation involving construction issues.

This practice group provides prompt, efficient, and goal oriented representation to its clients, always seeking to protect both the legal interests of its clients and the economic viability of specific projects. Our attorneys have amassed considerable experience in all areas involving legal issues in the construction industry.

This experience includes public contracting, bid disputes, timely advice on legal issues arising during construction projects, lien claims, and surety issues. Acknowledging the economic realities of today’s construction industry, the group’s attorneys focus on quickly identifying the goals of its clients and providing cost-effective legal services to reach those goals.

Chuck Baker has extensive experience in construction litigation relating to water intrusion and other alleged building defects. He is currently lead lawyer in the firm’s representation of Dryvit Systems, Inc. and Sto Corp., two of the nation’s biggest manufacturers and sellers of exterior insulation and finish systems (commonly called synthetic stucco).

The firm represents these companies throughout South Carolina. Mr. Baker is a member of the Construction Law Section of The Federation of Insurance and Corporate Counsel.

The firm’s Employment Practice Group encompasses all aspects of state and federal employment law, including employment discrimination, wrongful discharge, unemployment compensation, and wage and hour matters. Members of this group represent clients in state and federal court and before both state and federal administrative agencies (e.g., S.C. Human Affairs Commission, S.C. Department of Labor, S.C. Employment Security Commission, EEOC).

The firm also provides extensive advisory and counseling services in such areas as employment contracts, employee handbooks, restrictive covenants, family and medical leave, disability law requirements, and sexual harassment. The group is headed by a certified employment and labor law specialist.

Our attorneys are frequently called upon to lecture and author articles for business leaders and practicing attorneys and are active in state and national organizations focusing on employment law.

Our broad array of services include:

Approximately one half of the firm’s attorneys are active trial lawyers. We practice in the state courts of CA and surrounding counties and in the United States District Court for CA. Triumvir also has an active appellate practice and has been involved in many landmark decisions.

These include certificate of need and facility licensure concerns; medical staff privileges and corrective action; professional licensing and investigations by licensing agencies; physician recruitment and retention, managed care; alternate health care delivery systems; medical group practices, provider networks, professional corporations and partnerships

 joint ventures; Medicare and Medicaid fraud and abuse; state and federal self-referral (“Stark II”); compliance with the Health Insurance Portability and Accountability Act; hospital-based physicians; patient care, risk management; employment and labor issues; reimbursement and insurance concerns; environmental issues; contract matters; and tax concerns.

Our coverage practice includes particular experience in two sub-specialties: bad faith litigation and insurance fraud litigation. Our lawyers have been called on to defend major bad faith claims against insurers, and we are well equipped to address the difficult and sensitive aspects of those claims. With regard to insurance fraud litigation, our group includes lawyers who are approved counsel for Special Investigation Units (SIU) of major insurers, and we have broad experience in litigation involving arson, automobile claim fraud, and other suspicious claims.
